ACT ON THE PROMOTION OF SMART CITY DEVELOPMENT AND INDUSTRY

CHAPTER VI SUPPORT FOR SMART CITY INDUSTRY

Article 32 (Certification of Smart Cities)

1The Minister of Land, Infrastructure and Transport may certify the following to improve the level of smart cities and to facilitate vitalization of the smart city industry:

1. Smart cities
2. Smart city infrastructure
3. Services related to smart cities
4. Other matters specified by Presidential Decree

2Details regarding the standards for and methods of certification under paragraph (1) shall be prescribed by Presidential Decree.

Article 33 (Revocation of Certification)

The Minister of Land, Infrastructure and Transport may revoke certification that a person has obtained pursuant to Article 32 (1), as prescribed by Presidential Decree, in any of the following cases: Provided, That such certification shall be revoked in the case of subparagraph 1:

1. Where the person was certified by fraud

Article 34 (Placing Certification Marks)

1A person who was certified pursuant to Article 32 (1) may use a certification mark for the relevant smart city, smart city infrastructure, services related to the smart city, etc.; or may publicize that the person was certified (including publicity through electronic means such as the Internet; hereinafter the same shall apply), as prescribed by Presidential Decree.

2A person who fails to be certified pursuant to Article 32 (1) shall neither use a certification mark under Article 32 (1) or any similar mark, nor publicize as if the person was certified.

CHAPTER VI SUPPORT FOR SMART CITY INDUSTRY

Article 31 (Criteria and Methods for Certification of Smart Cities)

1To certify the matters specified in the subparagraphs of Article 32 (1) of the Act, the Minister of Land, Infrastructure and Transport shall establish and publicly notify certification criteria (hereinafter referred to as "certification criteria") in advance, including the following:

1. Certification indices and evaluation items for each subject of certification
2. Detailed evaluation criteria for each evaluation item, such as the objectives, methods, allocated points, calculation criteria, and minimum criteria.

2The Minister of Land, Infrastructure and Transport shall determine whether to grant certification by conducting written evaluations and field inspections in compliance with the certification criteria.

3Except as provided in paragraphs (1) and (2), matters necessary for the certification criteria and methods shall be publicly notified by the Minister of Land, Infrastructure and Transport in consulting with the Minister of the Interior and Safety and the heads of other relevant central administrative agencies.

Article 32 (Revocation of Certification)

1To revoke certification for smart cities, etc. pursuant to Article 33 of the Act, the Minister of Land, Infrastructure and Transport shall provide a person who was certified with advance notice of the revocation, specifying the grounds for revocation and the period for submitting explanatory materials.

2Where a person in receipt of advance notice of the revocation under paragraph (1) fails to submit any explanatory materials within the submission period, the Minister of Land, Infrastructure and Transport shall give the second advance notice thereof to such person.

3Where a person who was certified fails to submit any explanat

4Upon revoking certification, the Minister of Land, Infrastructure and Transport shall notify the relevant person who was certified of such fact without delay; and shall post it on the website of the Ministry of Land, Infrastructure and Transport.

Article 33 (Placing Certification Marks)

Where a person who was certified for a smart city, etc. intends to use a certification mark or to publicize the fact that he or she was certified pursuant to Article 34 (1) of the Act, the person shall do so according to the methods of placing certification marks prescribed and publicly notified by the Minister of Land, Infrastructure and Transport.
